چكيده :
اعتياد به مواد مخدر در خانواده و جامعه در بين اقشار مختلف بهخصوص جوانان منجر به اختلالات و نابساماني در ابعاد مختلف آن ميشود ازجمله ابعاد خانواده، اقتصاد، امنيت، سياست و... است كه در صورت آسيب ميتواند مانعي مهم در پيشرفت و توسعه كشور محسوب شود. پژوهش حاضر به بررسي آثار فقهي- حقوقي اعتياد در خانواده در سه بعد طلاق، نفقه، حضانت فرزندان ميپردازد؛ كه بهصورت توصيفي- تحليلي به بررسي موضوع با توجه به منابع موجود پرداخته ميشود. دستاوردها حاكي از آن است كه خانواده بهعنوان اولين نهاد سازندهاي كه فرد با آن آشنا ميشود تأثير به سزايي در شكلگيري شخصيت افراد دارد و در صورت آسيب به اين نهاد ميتواند عاملي مهم در تحقق و افزايش انواع انحرافات، بزهكاريها و جرائم و... در سطح يك جامعه باشد، بهويژه اعتياد به مواد مخدر كه منجر به بروز مشكلات و اختلالاتي در سطح خانواده و جامعه مي¬شود. بررسيها نشان ميدهد اولين تأثير اعتياد در خانواده بهصورت طلاق زوجين محقق ميشود زيرا زوج معتاد بهتدريج در اثر اعتياد خود توانايي كسب درآمد و تأمين هزينه زندگي زوجه و فرزندان درنتيجه ادارهي زندگي را از دست ميدهد و زوجه براي رهايي از اين شرايط و حفظ مصلحت فرزندان از دادگاه تقاضاي طلاق ميكند. براي مقابله و كاهش اثرات اين معضل در سطح جامعه بهترين راه بهكارگيري سياست پيشگيري ميباشد كه بهصورت نظارت صحيح و ايجاد ارتباط مناسب و تدوين برنامهها و آموزشهاي مختلف بر پايه اين معضل در سطوح مختلف با حمايت مراكز و دستگاههاي ذيربط ازجمله آموزشوپرورش، صداوسيما، وزارت كشور و... تحقق مييابد.
چكيده انگليسي :
Drug addiction cause disorder and chaos on families and communities among different societies, especially young people in various dimensions like: family, economy, safety, and politics and …. That can be one of the main barriers in country's improvement and development. The current study investigates the legal-judicial effects of addiction on three dimensions of children custody, divorce and alimony; with a descriptive-analytical method. The results showed family, as the first institution that individuals belongs to, have a considerable effect on people's personality and its damage can be an important factor in achieving and increasing various types of deviations, Crimes and Misdemeanors in a community; in particular, drug addiction that led to the problems and difficulties in the family and society. The results showed that first effect of addiction is in case divorce; as addicted husband gradually would fail to earn a living and cover cost of living of his wife and children; so The wife has to get out of this situation and maintain the interest of children with divorce. To counter and mitigate the effects of this problem at the community level, prevention policy is the best way that can be applied with Proper monitoring, Good communication, Different training and Programs Based on this problem at various levels and with support of relevant centers and agencies including Education section, media and broadcasting, Ministry of Interior and etc.
