چكيده :
اصل اوليه در عقود تمليكي بيع و اجاره، اصل لزوم است اما با اين وجود اصل لزوم قراردادها از گزند ضرورتها در امان نمانده است از اين رو نبايد آن را مطلق پنداشت و در مواردي بر اين اصل استثنائاتي وارد شده است از جمله اين استثنائات پديده عذر است كه نيروي الزامآور عقد را از بين ميبرد. در واقع عذر عاملي است كه خارج از اراده آدمي باشد و بر اراده او اثر بازدارنده گذارد بحث عذر در دو عقد بيع و اجاره ظهور چشمگيرتري پيدا كرده است بهطوري كه در صورت وقوع عذر، تأثير آن با توجه به دائمي و موقت بودن متفاوت است كه در صورت موقت بودن سبب ايجاد حق فسخ ميشود و يا تعليق قرارداد را به دنبال خواهد داشت اما در صورت دائم بودن اثر وضعي عذر معافيت از مسئوليت و سقوط تعهد است و در مورد اثر تكليفي آن اختلافنظر وجود دارد و نميتوان اثر را بهطوركلي انفساخ يا بطلان يا خيار دانست بلكه بايد قائل به تفصيل شد در واقع اثر عذر بسته به زمان بروزش متغير است. بهطوريكه زمان بروز عذر عام شاخصهي اصلي در تأثير فقهي آن است.
چكيده انگليسي :
The principle of necessity is the first principle in sale and rent possessory
contracts. But however the principles of necessity of contracts are not
spared from harm of necessity. Therefore should not assumption that is
absolute. And in cases com exception on this principle. Including this
exception is impediment phenomena .eliminates the binding force of
contract in fact apology is factor that is out of the will of man. Its deterrent
effect on his will. Discussion impediment has become emergence of
significant in both sale and rent contracts. Therefore in the event of an
impediment, its impact is different due to the be permanent and temporary.
That is temporary impediment the right to option or suspension of contract
will follow. But the effects of position impediment in are permanent is
exemption from liability and fall wedding. And the effect of its charging,
there are disagreements. And not be knew the overall effect termination or
invalidity or option. But should be allowed to be discussed. In fact the effect
of impediment depending on the time they unfold is varies. So that the
timing of the common impediment is main index in its effect legal.
