در فقه اسلامي قاعده‌اي به نام «لاضَرَر و لاضِرار» وجود دارد. اين قاعده به‌منظور حفظ حقوق همه انسان‌ها و تنظيم روابط فردي و اجتماعي و جلوگيري از اختلافات و اختلال در نظم جامعه تشريع شده است، اين قاعده ازآن‌رو كه اختصاص به ابواب معيني از فقه ندارد يك قاعده فقهي عام اسـت؛ با توجه به بررسي‌هاي انجام‌گرفته تاكنون پژوهشي به‌طور مستقل به كاربرد قاعده لاضرر در تعليم و تربيت نپرداخته است وليكن پژوهش‌هايي انجام‌گرفته است كه با اشاره‌اي كوتاه و مجمل بر كاربرد اين قاعده در تعليم و تربيت پرداخته‌اند، پژوهش حاضر با روش توصيفي – تحليلي و ابزار از نوع كتابخانه‌اي و اسنادي و استفاده از نرم‌افزارهاي فقهي به دنبال بررسي اين قاعده در تعليم و تربيت مي‌باشد. نتايج بيانگر آن است كه اين قاعده مي‌تواند از كرامت متربيان حمايت كند و مانع هر عامل و روشي كه در تعليم و تربيت باعث ضرر رساندن به شخصيت و آبرو و جسم و بدن متربيان قرار گيرد، باشد و قاعده لاضرر محدود به ضررهاي مادي نمي‌باشد و هر نوع ضرري اعم از مادي و معنوي كه بر روي متربيان وارد شود اين قاعده مي‌تواند به‌عنوان محدودكننده آن قرار گيرد و از وارد ساختن هر نوع ضرري جلوگيري كند.

In islamic jurisprudence is a rule as prohibition of detriment,)la-zarar(.This rule has canonization to protecting all human's right's,and setting individual and social communication.And with enforcing this rule can avoiding the disputes in society.Although this rule does'nt special to is defined jurisprudence conflict,it is a general rule .As it is a general rule ,it can be implication origin for very cases.With attention to past survey's ,we get that wasnt any independent research of enforcing this rule in cultivation and teaching.And researches has done ,got a short and abridgement point about this rule and relating it to cultivating and teaching.The aim of this research is that with analysis and describing way survey this rule and teaching and cultivating. The equipment of this research is library,document ,jurisprudence software.The result of this research is that with supporting trainee's munificence ,avoid damaging to them. Any even honor ,mentally.body or identity damages that is result of cultivation's action. So this rule is not limited to physically damage's.And it conclude to any damages to trainees from physically to abstract damages .This rule can restrict any damages.We can consider this rule as supporting rule ,that supports munificence and self respect of trainees .
