قاعده نفي سبيل از قواعد مهم فقهي است كه فقها آن را در بسياري از موارد مبناي استنباط احكام شرعي قرار داده¬اند. و مستند آن، آيات، روايات، اجماع، عقل مي¬باشد. براساس اين قاعده هرگونه رابطه يا عملي كه موجب شود كافر راهي براي تسلط بر مسلمان پيدا كند، حرام است. به مقتضاي اين قاعده، هر عقد و پيمان و معامله، و قراردادي كه باعث علو و برتري و تسلط كافر بر مسلمان شود، اعتبار ندارد. از اين قاعده مي¬توان در ابعاد سياسي، اقتصادي، نظامي، اجتماعي و فقهي استفاده¬هاي فراوان كرد و در جاي جاي فقه از آن بهره مند شد، اما در عصر حاضر كه سلطه و نفوذ كشورهاي بيگانه واستعماري در شكلهاي مختلف بر مسلمانان و كشورهاي آنها سايه افكنده است، يكي از بهترين راهها براي نجات و بيرون رفتن از اين وضع ذلت بار، توجه و عمل به اين قاعده است؛ زيرا اين قاعده هر گونه كاري را كه سلطه و نفوذ بيگانه را در پي داشته باشد حرام و غير مشروع مي داند و مبارزه با آن را لازم و واجب مي¬شمارد. از جمله در كشور ما نظريه اقتصاد مقاومتي كه اجراي صحيح آن مي¬تواند در زمينه هاي گوناگون كشور را از وابستگي به بيگانگان نجات دهد،. و عملي شدن مفاد قاعده نفي سبيل در اقتصاد مقاومتي، باعث كمرنگ شدن نفوذ كفار بر كشور و بسته شدن راه نفوذ بيگانگان خواهد شد
