چكيده :
قاعده مقابله به مثل يكي از قواعد مهم با پايه و مبناي مستحكم در دين اسلام است. اما تاكنون در مورد اين قاعده و كاربردهاي آن در حقوق تحقيقات چنداني صورت نگرفته است. اين تحقيق به گستره قاعده مقابله به مثل در فقه و حقوق موضوعه پرداخته و سعي شده است تا با استفاده از منابع موجود، چارچوب و ابعاد اين قاعده پركاربرد مورد بررسي و مداقه قرار گيرد. از آنجا كه مهمترين دليل اين قاعده آيات قرآن كريم ميباشند، زمينههاي فقهي اين قاعده نيز همراه با دلايل عقلي آن از اهميت برخوردار هستند. براي رسيدن به اين هدف، تعدادي سوال مطرح شده و تلاش شد تا با پرداخت دقيق به موضوع، به سوالات مطروحه پاسخ داده شود. همانگونه كه در اين تحقيق مورد بررسي قرار گرفته است، محققان چارچوبهاي بسيار مهمي را براي اين قاعده مطابق آيات قرآن كريم بيان كردهاند. بر اساس نتايج بدست آمده، در اين زمينه ميتوان گستره قاعده مقابله به مثل را در سه زمينه حقوق خصوصي، حقوق جزا و حقوق بينالملل بررسي نمود. در زمينه حقوق خصوصي، مهمترين زمينه قاعده مقابله به مثل، تقاص است كه در حيطههاي تناسب، زمان، تعداد، شكل، روح و كيفيت مقابله داراي اهميت هستند. در زمينه حقوق جزا، جرايم وارد بر جسم و مقابله به مثل مورد بررسي قرار گرفتهاند. در زمينه حقوق بينالملل نيز آيه اعتداء مهمترين دليل برهان قاعده مقابله به مثل است كه در سه زمينه «فقط واكنش»، «نفي آسيب به غيرنظاميان» و «حفظ كشور مقدم بر مقابله به مثل» فرصت ظهور يافته است.

The rule of retaliation is one of the most important rules with a strong foundation in Islam. But so far little research has been done on this rule and its applications in law. This research has dealt with the scope of the rule of retaliation in jurisprudence and law and has tried to examine the framework and dimensions of this widely used rule using existing sources. Since the main reason for the rule of Quranic verses are no legal grounds along with rational reasons for it are important. To achieve this goal, a number of questions were asked and an attempt was made to answer the questions by paying close attention to the issue. As discussed in the study, the researchers an important framework for the rule expressed in accordance with Quranic verses. Based on the obtained results, in this field, the scope of retaliation rule can be examined in three areas: private law, criminal law and international law. In the field of private law, the underlying principle of retaliation, vengeance is in the fields of fitness, time, number, shape, spirit and fighting qualities are important. In the field of criminal law, crimes against the body and retaliation have been investigated. Atday verse in the field of international law because the rule of reciprocity is proof that in three areas, "just reaction," "negates the damage to the civilian population" and "maintain the state prior to retaliate" Opportunities are emerging.
